Automobile accident. Plaintiff Dorothy McCourt was injured in a head-on collision between the car she was driving and one driven by defendant Algiers. She sued Algiers and his insurer, alleging that negligence of Algiers had caused her injuries. Defendants answered denying that Algiers was negligent in any respect and alleging that plaintiffs own negligence was the sole cause of the collision. Thereafter, by pleading, motion and offer of evidence, McCourt contended that the negligence of Algiers and her own freedom from negligence had been conclusively determined in her favor by the district court of the United States for the western district of Wisconsin in a previous action in which Twila Rude, a passenger in McCourts car, was plaintiff, and that the negligence issues were res judicata; but the trial court held otherwise, excluding evidence of the federal court action and submitting questions on negligence to the jury. The jury found that Algiers was not negligent and that McCourt was negligent with respect to lookout, management and control and driving on the wrong side of the road. McCourts motions after verdict were denied, and judgment was entered on the verdict dismissing her complaint, from which judgment she appeals.
